Welcome to Riderr. These Terms of Service govern your access to and use of our electric skateboard ride-tracking platform, including our mobile and web applications, APIs, and all associated features. Please read them carefully before you ride.
01Acceptance of Terms
By downloading, installing, or otherwise accessing or using Riderr (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Riderr Inc. ("we," "us," or "our"). Your continued use of the Service following any updates to these Terms will constitute your acceptance of the revised Terms. If you are accessing the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
02Use of the Service
Riderr grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms. You may use the Service only in compliance with these Terms and all applicable local, national, and international laws and regulations. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party should we exercise such rights. The Service is intended for riders aged 16 and older. By using the Service, you confirm that you meet this age requirement.
03User Accounts
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorized use of your account. We reserve the right to terminate accounts that are found to contain inaccurate or misleading information, or that have been inactive for an extended period of time without prior notice.
04Ride Data & Content
When you use Riderr to record rides, you generate data including GPS traces, speed metrics, distance measurements, elevation profiles, battery telemetry, and other performance statistics ("Ride Data"). You retain ownership of all Ride Data you create. By recording and storing Ride Data within the Service, you grant us a limited, worldwide, royalty-free license to store, process, and display that data solely for the purpose of providing the Service to you. You may export or delete your Ride Data at any time from your account settings. Aggregated and anonymized ride statistics may be used by us to improve the Service and to generate insights about electric skateboard usage trends.
05Prohibited Conduct
You agree not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the Service in any medium; (b) using any automated system to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce; (c) transmitting spam or other unsolicited communications; (d) attempting to interfere with, compromise the system integrity of, or decipher any transmissions to or from our servers; (e) taking any action that imposes an unreasonable load on our infrastructure; (f) uploading invalid data, viruses, or other harmful code; (g) collecting or harvesting any personally identifiable information from the Service; (h) using the Service for any commercial solicitation purposes; or (i) impersonating another person or misrepresenting your affiliation with any person or entity.
06Termination
We may suspend or terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. If you wish to terminate your account, you may do so by contacting us at [email protected] or by using the account deletion feature within the app settings. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity provisions, and limitations of liability. Upon termination, your right to use the Service will immediately cease.
07Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. RIDE DATA DISPLAYED IN THE SERVICE, INCLUDING GPS ROUTES, SPEED READINGS, AND BATTERY METRICS, IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR SAFETY-CRITICAL DECISIONS.
08Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RIDERR INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS PAID BY YOU TO RIDERR IN THE TWELVE MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
09Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, sending a notification through the Service or to the email address associated with your account. We encourage you to review these Terms periodically to stay informed about our policies. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and, if applicable, delete your account.
